Pt 2 - The Family Court of Australia
This episode is on the Family Court of Australia, which is known as the FCFCOA, after merging with the Federal Court in 2021 (forming the Federal Circuit and Family Court of Australia).
I also give a brief history lesson on the foundations of English common law in Australia and when matrimonial legislation was first introduced to provide rules, regulations, and protection for family and children.
Before getting to Family Court, several mandatory, arduous tasks known as Pre-Action Procedures need to be completed first. Some of these are:
- Family Dispute Resolution (FDR - can be done by telephone or video conference)
- Obtain a Section 60I (S60I) Certificate
- File a Notice of Intention to Commence Proceedings
- File a Genuine Steps Certificate
Depending on your situation, you may also be required to complete a number of court ordered directions, such as; counselling, parenting courses, a family report, or psychiatric evaluations etc.
